1. Agreement to these terms
Somporko AI™ is a product of Somporko™. Somporko™ is our relationship-first technology platform for communication, service, and human connection. Somporko AI™ is our AI-powered receptionist and communication product for service businesses and professional offices.
In these Terms and Conditions, “Somporko,” “Somporko AI,” “we,” “us,” and “our” refer to Somporko™, Somporko AI™, and the related websites, products, services, tools, communications, AI-powered workflows, and future product directions we provide or develop.
These Terms and Conditions govern your access to and use of the Somporko™ and Somporko AI™ websites, early-access forms, demos, communications, and related services. By using the website or requesting information, you agree to these terms.
2. Early-stage service
Somporko AI is an early-stage product. Features, availability, pricing, integrations, supported use cases, and performance may change over time. Submitting an early-access request does not guarantee access, availability, pricing, support, or a future commercial relationship.
Somporko™’s broader vision is to build relationship-centered products and services, including human-in-the-loop feedback, expert-guided AI improvement, communication tools, and other human-connection technologies. References to future ideas, product directions, or vision statements are informational only and do not guarantee that any specific product, feature, timeline, or service will be offered.
3. No professional advice
Somporko AI is a communication and workflow technology provider. It does not provide medical, legal, financial, insurance, emergency, or professional advice. AI responses should not be relied on as professional judgment.
4. Emergency and regulated-use limitations
Somporko AI should not be used for emergencies or situations requiring immediate human response. If a caller is experiencing an emergency, they should contact emergency services directly.
Customers using Somporko AI in healthcare, financial, legal, insurance, employment, or other regulated settings are responsible for configuring and using the service in compliance with applicable laws, rules, industry requirements, and customer policies.
5. AI limitations
AI systems can misunderstand callers, produce incomplete or inaccurate responses, fail to complete tasks, or be unavailable. Customers are responsible for testing workflows, monitoring performance, reviewing outputs, and providing human oversight where appropriate.
6. Customer responsibilities
Customers and businesses using Somporko AI are responsible for the content of their prompts, scripts, workflows, integrations, data inputs, call notices, recording/transcription notices, opt-in and opt-out flows, customer communications, and legal compliance for their specific use case.
Customers must not use Somporko AI to send unlawful, deceptive, abusive, harassing, discriminatory, fraudulent, or unauthorized communications.
7. Website inquiries and early access
The Early Access form is for businesses and organizations interested in Somporko AI products. It is not a consumer SMS opt-in form and does not enroll anyone in SMS messages. We may contact you about your inquiry using the information you submit.
8. Acceptable use
You may not use the website or services to violate law, infringe rights, interfere with systems, reverse engineer or misuse the service, upload malicious code, scrape without permission, impersonate others, or attempt to access data or systems without authorization.
9. Third-party services
Somporko AI may use or integrate with third-party services for hosting, email, telephony, SMS, AI processing, scheduling, analytics, payments, and other functions. Third-party services may have their own terms, policies, limitations, and availability.
10. SMS Terms
Somporko AI may send SMS messages only when a caller requests or agrees to receive text messages during an interaction with our AI receptionist or office communication system. SMS messages are service-related and may include appointment confirmations, appointment reminders, inquiry follow-up, demo follow-up, service updates, and related communications.
Somporko AI does not send unsolicited SMS marketing campaigns. The website Early Access form is for business inquiries and is not used as an SMS opt-in form.
By asking for a text message or confirming that you would like to receive one during the call, you agree to receive SMS messages from Somporko AI or the office/business using Somporko AI for that specific interaction or related service communication.
Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for help. Consent to receive SMS messages is not a condition of purchase or use of Somporko AI services. Carriers are not liable for delayed or undelivered messages.
Mobile phone numbers, mobile opt-in information, and SMS consent will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for more information.
11. Fees and commercial terms
If paid services are offered, fees, billing terms, cancellation terms, service levels, support, and other commercial terms will be set out in a separate agreement, order form, or written terms provided for that service.
12. Intellectual property
Somporko™, Somporko AI™, the Somporko logo, website content, designs, product concepts, software, workflows, and related materials are owned by Somporko or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or use them except as permitted by us in writing.
All third-party names, logos, and marks are the property of their respective owners.
13. Feedback
If you provide ideas, suggestions, comments, or feedback, you allow us to use them without restriction or compensation, unless we agree otherwise in writing.
14. Confidentiality and sensitive information
Do not submit confidential, regulated, or sensitive information through the website unless necessary for your inquiry and you are authorized to share it. Business customers are responsible for determining what data may be entered into their Somporko AI workflows.
If future Somporko services involve human feedback, expert review, AI evaluation, training examples, or similar workflows, users and customers are responsible for ensuring they have the rights and permissions needed to provide that content and for avoiding unnecessary sensitive information.
15. Privacy
Our Privacy Policy explains how we collect, use, and share information. By using the website or services, you acknowledge the Privacy Policy.
16. Changes and availability
We may update, suspend, discontinue, or change the website or services at any time. We may also update these Terms and Conditions by posting a new version on this page.
17. Disclaimers
The website and services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.
18. Limitation of liability
To the maximum extent permitted by law, Somporko and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or loss of goodwill arising from or related to the website or services.
19. Indemnification
If you use Somporko AI on behalf of a business or organization, you agree that the business or organization is responsible for its configuration, use, prompts, workflows, communications, compliance obligations, and customer interactions, and you agree to defend and indemnify Somporko from claims arising from that use to the extent permitted by law.
20. Governing law
Unless otherwise required by law or agreed in writing, these terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
